These Terms of Service (“Terms”) govern your use of the website operated by PhotographyQR located at http://www.photography.com (the “Site”). By accessing or using the Site, you agree to be bound by these Terms.
1. Acceptance of Terms
By using this Site, you affirm that you are 18 years of age or older and agree to comply with and be bound by these Terms. If you do not agree to these Terms, you may not access or use the Site.
2. Intellectual Property Rights (Copyright)
A. Ownership of Content
All content, including all photographs, images, text, graphics, logos, and digital assets available on the Site, is the property of the Photographer or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.
B. Restrictions on Use
You are granted a limited, non-exclusive, non-transferable, and non-sublicensable license to access and use the Site for personal, non-commercial purposes.
- You may not copy, reproduce, modify, distribute, display, perform, or transmit any of the Site’s content without the prior written consent of the Photographer.
- You may not use any image from the Site for commercial purposes, resale, or redistribution without obtaining a separate, written commercial license from the Photographer.
3. Client Galleries and Image Licensing
If you are a client of the Photographer, the terms regarding image delivery, usage rights, and print specifications will be governed by a separate written Photography Services Agreement or Contract signed by both parties.
- Personal Use License: Unless otherwise specified in your contract, all delivered digital images or prints are provided with a limited, personal use license. This typically allows you to reproduce the images for personal purposes (e.g., sharing on social media, printing for home display) but prohibits commercial use, sale, or entry into contests without explicit permission.
- Photographer’s Right to Use: The Client acknowledges and agrees that the Photographer retains the copyright to all images and may use the images for self-promotion, marketing, portfolio display, and publication, unless a separate written agreement prohibiting such use is executed.
4. User Conduct
You agree not to use the Site to:
- Upload, post, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
- Impersonate any person or entity.
- Interfere with or disrupt the operation of the Site.
- Attempt to gain unauthorized access to any portion or feature of the Site.
5. Disclaimer of Warranties
The Site and all content are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
6. Limitation of Liability
In no event shall the Photographer, its directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site, even if 1we have been advised of the possibility of such damages.
7. Indemnification
You agree to defend, indemnify, and hold harmless the Photographer from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of your use of the Site or breach of these Terms.
8. Governing Law
These Terms and your use of the Site are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.
9. Changes to Terms
We reserve the right to revise these Terms at any time. The updated version will be indicated by an updated “Effective Date” and the changes will be effective immediately upon posting. Your continued use of the Site after the posting of the revised Terms constitutes your acceptance of the changes.
